This Privacy Policy explains how NotOnMarket.ca (“NotOnMarket.ca,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you use the NotOnMarket.ca platform at NotOnMarket.ca and related services (the “Platform”).
We are committed to handling personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. By using the Platform, you consent to the practices described in this Policy.
This Policy applies to all users of the Platform, including licensed real estate professionals, investors, and members of the public who create an account or submit information through the Platform.
2.1 Account Information: Full name, email address, phone number, password (stored only in hashed form by our authentication provider), professional category, brokerage and board information (if applicable), province, and city.
2.2 Listing and Property Information: Property addresses, descriptions, images, financial details, documents, and contact preferences you provide when submitting listings.
2.3 Search and Preference Information: Saved search criteria, filters, buyer search details, and favorites.
2.4 Communications: Inquiries, contact requests, and messages sent through the platform.
2.5 Account Security Information: Session tokens, sign-in records, and account status information used to maintain security.
2.6 Payment Information (future): Subscription and billing status. We do NOT store credit card or banking details directly. Payment processing will be handled by a third-party provider.
2.7 Technical Information: Standard log data (access times, browser information) used for security and troubleshooting.
We use personal information to: (a) create, review, and manage accounts; (b) operate core features including listings, searches, and inquiries; (c) send transactional and service emails; (d) maintain platform security; (e) process subscriptions (when active); (f) respond to support requests; (g) detect and prevent fraud and abuse; and (h) comply with legal obligations.
We do not sell your personal information.
Some information you provide is visible to other approved users based on your settings and the visibility rules of each listing. You control your contact preferences. Listing information is displayed according to the access level of the viewing user.
We use third-party service providers including hosting (Vercel), database and authentication (Supabase), and transactional email delivery. These providers may process data outside Canada, including in the United States. We do not share personal information for third-party advertising.
We keep personal information for as long as your account is active and as needed to provide the Platform. Certain records (such as audit logs and moderation records) may be retained for compliance purposes even after account closure.
We use administrative, technical, and physical safeguards including gated access, manual account review, encrypted credentials, row-level security policies, and signed URLs for private documents. No system is completely secure.
Subject to applicable law, you may: access the personal information we hold; request correction; withdraw consent (which may limit your use of the Platform); and request deletion of your account, subject to information we are required to retain.
We send transactional emails necessary to operate the Platform. Where required by CASL, we obtain appropriate consent. You may manage non-essential email preferences in your account settings.
The Platform uses cookies and similar technologies to keep you signed in and operate security features. You can control cookies through your browser settings.
The Platform is intended for users aged 18 and older. We do not knowingly collect personal information from anyone under 18.
We may update this Policy from time to time. We will revise the “Last Updated” date and, where appropriate, notify you or require renewed acceptance.
